The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person viewing this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of the United Kingdom. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

These terms and conditions outline the rules and regulations for the use of Clerkenwell Computers and our services.
By accessing this website we assume you accept these terms and conditions. Do not continue to use Clerkenwell Computers if you do not agree to all of the terms and conditions stated on this page.

Law

This agreement shall be governed by English law and is subject to the jurisdiction of the English courts.

General Terms

Clerkenwell Computers provide an ad-hoc, on-site IT service based on an hourly rate as described below.

Please be advised that the client must be at least 18 years of age and be responsible for all decision making. The client must remain on the premises whilst our employees are in attendance.

We do not repair any equipment that is under manufacturer warranty, however, we do endeavour to liaise with the manufacturer on your behalf for repair or replacement purposes.

We cannot accept any liability for loss or corruption of data, We strongly recommend that you perform regular offsite backups.
Payments

Invoices are due upon receipt, unless otherwise stated. We are happy to accept cash, card, or BACS payment. We currently use PayPal to securely process and verify all card payments.

On-site service charges quoted apply to locations within a 1 mile radius of our office address.

Direct Debit

Direct Debit payments are available on our hosting plans and support contracts. We use the GoCardless systems to collect and store your bank details. Payments are collected on the 1st of the month unless otherwise agreed. Any changes to the payment date and/or amounts to be debited from your account will be notified at least 30 days in advance and in line with Direct Debit guarantees.

Complaints

We acknowledge that from time to time mistakes can happen. If you feel that something is not quite right, please contact us so that we can resolve your issue in a timely manner.
Refunds

Your consumer rights protect you when buying goods or services. This means if you’re unhappy, we are obliged to put things right. If we are unable to repair or replace an item, you will be entitled to a full refund.

IT Support Services Additional Terms

1: All prices include Call Out Charge.
2: Payment required on completion of job, unless prior agreement has been made.
3: Parts are additional to all charges. We do not hold any parts in stock, prices of parts are estimated and final price will be shown on your invoice.
4: We aim to purchase parts for arrival next working day. However this cannot always be guaranteed and we will advise accordingly if this is the case.
5: Hourly Charges are per hour or part thereof. Minimum Charge of 1 Hour applies to all Hourly Rates.
6: Free Support is timed by the minute.
7: Rollover time maximum 3 hours (180 minutes). Maximum allowed free time per month 4 hours (240 minutes).
8: Once free time limit is reached, no further time will be added until time begins to be used.
9: Once free time is fully depleted, a special discounted hourly rate of £60 will apply.
10: Contract cancellation period is 1 calendar month before next payment date. Any notice given less than this will incur a further 1 month payment before the contract is cancelled.
11: Failure to pay for whatever reason may result in cancellation of contract. Any free time incurred will be forfeit.
12: Due to the amount of time it takes to remove a virus, this is charged at a flat rate.
13: Should any additional work be required beyond the remit of a flat rate service, then our standard PAYG rate applies for the entire job.
14: Flat Rate services are NOT included in the monthly contract due to length of time these can take. This is in your best interests.
15. We reserve the right to alter our hourly rates without prior notice. Please ensure you check our site for up-to-date information.
16. We reserve the right to alter our contract prices at any time. The new rate will come into force on the next billing cycle after the notice period has expired (See Direct Debit details above).

Website Hosting Additional Terms

Licenses

Unless otherwise stated, Clerkenwell Computers and/or its licensors own the intellectual property rights for all material on Clerkenwell Computers. All intellectual property rights are reserved. You may access this from Clerkenwell Computers for your own personal use subjected to restrictions set in these terms and conditions.

You must not:
• Republish material from Clerkenwell Computers
• Sell, rent or sub-license material from Clerkenwell Computers
• Reproduce, duplicate or copy material from Clerkenwell Computers
• Redistribute content from Clerkenwell Computers

This Agreement shall begin on the date shown at the top of these Terms and Conditions.

Parts of this website may offer an opportunity for users to post and exchange opinions and information. Clerkenwell Computers does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of Clerkenwell Computers, its agents and/or affiliates. Comments reflect the views and opinions of the persons who post their views and opinions. To the extent permitted by applicable laws, Clerkenwell Computers shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.
